By submitting your device for repair services or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and the liability waivers contained herein.
1. Liability Waiver
By using our services, you agree to release Superior Electronics & Repair from liability for any data loss, device damage, or other losses that occur during repair, unless caused by our gross negligence or willful misconduct. You understand that:
- Any warranties provided by parts manufacturers are separate from our labor warranty
- You assume all risk associated with shipping devices to and from our facility
- Our total liability for any claim shall not exceed the amount paid for the specific service that gave rise to the claim
2. Repair Services
2.1 No Guarantee of Successful Repair
Superior Electronics & Repair will make every reasonable effort to successfully diagnose and repair your device. However, we cannot and do not guarantee that:
- All repairs will be successful
- Your device will be restored to full functionality
- All issues with your device can be resolved
- The repair will meet your specific expectations
Some devices may have damage beyond repair, underlying issues that are not immediately apparent, or complications that arise during the repair process. We will inform you of any such issues discovered during diagnosis or repair.
2.2 Diagnostic Services
Diagnostic services are provided to assess the condition of your device and determine the feasibility of repair. A diagnostic fee may apply. The diagnostic process itself carries no guarantee of a successful repair outcome.
3. Data and Information
3.1 Data Loss and Backup Responsibility
Important: You are solely responsible for backing up all data, files, programs, and information on your device before submitting it for repair. Superior Electronics & Repair:
- Does NOT guarantee data preservation during repair
- Is NOT responsible for any data loss, corruption, or deletion
- Is NOT obligated to back up your data
- Strongly recommends you create backups before submitting your device
3.2 Data Recovery Services
If you request data recovery services, we will make reasonable efforts to recover your data. However, we cannot guarantee successful data recovery. Data may be permanently lost due to physical damage, encryption, file system corruption, the age and condition of the device, or other technical limitations.
3.3 Privacy and Confidentiality
Our technicians will only access data necessary to diagnose or verify repairs. While we respect your privacy and will not intentionally access, view, or copy your personal data beyond what is required, we cannot guarantee complete privacy or confidentiality of data remaining on your device. You should remove or secure all sensitive information before submitting your device for repair. If you have specific confidentiality requirements, you must notify us in writing before repair begins.
4. Shipping and Transportation
4.1 Shipping Liability
If you choose to ship your device to us, you acknowledge and agree that:
- Devices may be damaged, lost, or stolen during shipping
- Superior Electronics & Repair is NOT responsible for damage or loss during shipping to or from our facility
- You assume all risk of loss or damage during transit
- We strongly recommend insuring valuable devices and using a tracked shipping method
4.2 Return Shipping
When we return your device, we will use reasonable care in packaging. However, we are not liable for damage that occurs during return shipment. We recommend purchasing shipping insurance for valuable items.
5. Parts and Components
5.1 Replacement Parts
We use quality replacement parts from various suppliers. Replacement parts may be new, refurbished, or aftermarket. We do not guarantee that aftermarket parts will perform identically to original manufacturer parts, and part availability may affect repair timelines.
5.2 Part Failure
While we stand behind our workmanship, electronic components can fail. We offer a warranty on our labor (see Section 7), but cannot guarantee that replacement parts will never fail. If a replacement part fails due to a manufacturing defect within the warranty period, contact us and we will assist you in pursuing a remedy through the part supplier where applicable.
6. Device Condition and Pre-Existing Issues
6.1 Undisclosed Damage
You are responsible for disclosing all known issues with your device at the time of intake. We are not responsible for pre-existing damage not disclosed during intake, hidden defects discovered during repair, additional issues that become apparent after the initial repair, or damage caused by previous unauthorized repair attempts.
6.2 Water and Liquid Damage
Water and liquid damage can cause unpredictable long-term effects. Even if initial repairs are successful, additional issues may develop later. We cannot guarantee the long-term functionality of devices that have suffered liquid damage.
7. Warranty and Limitations
7.1 Limited Labor Warranty
We provide a limited warranty on our labor for 30 days from the date of repair completion. This warranty covers defects in workmanship and failures of repairs performed by us that are directly related to the specific repair performed.
7.2 Warranty Exclusions
Our warranty does NOT cover:
- Damage caused after the device is returned to you
- Issues unrelated to the original repair
- Normal wear and tear
- Water or liquid damage that occurs after repair
- Damage from drops, impacts, or misuse after repair
- Software issues not directly related to hardware repair
- Issues with third-party apps or operating systems
- Parts that fail due to manufacturing defects (see Section 5.2 for part supplier warranty guidance)
8. Limitation of Liability
8.1 Maximum Liability
To the fullest extent permitted by law, Superior Electronics & Repair's total liability for any claim arising from or related to our services shall not exceed the amount you paid for the specific service that gave rise to the claim.
8.2 Consequential Damages
Superior Electronics & Repair is not liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of data, loss of business, lost profits, loss of use, or any other damages arising from the repair process.
9. Payment and Quotes
9.1 Quotes and Estimate Approval
Any quotes provided are estimates based on information available at the time. Actual repair costs may vary based on diagnostic findings, parts availability and cost, or additional issues discovered during repair. We will contact you for approval before proceeding with any work that exceeds the original estimate. Work will only proceed upon your explicit authorization.
9.2 Payment Terms
Payment is due upon completion of services unless otherwise agreed in writing. Devices may be held until payment is received in full.
10. Customer Responsibilities
10.1 Authorization and Preparation
By providing your device for repair, you confirm that you are the owner of the device or are authorized to authorize repairs on behalf of the owner. You are responsible for:
- Backing up all data before submitting your device
- Removing SIM cards, memory cards, and accessories
- Providing accurate contact and device information
- Providing access codes or passwords necessary for testing and repair
- Removing or securing any sensitive or confidential information
- Disclosing all known issues and prior repair history at intake
10.2 Communication Consent
You agree to be contacted by phone, email, or text message regarding repair status, quotes, approvals, and follow-up communication.
11. Abandoned Devices
11.1 Storage Fees and Disposal
Devices left unclaimed for more than 30 days after we have notified you of repair completion may be considered abandoned. We reserve the right to charge reasonable storage fees and to dispose of or recycle abandoned devices in accordance with applicable laws to recover unpaid costs.
12. Software Services
12.1 Software Limitations
Software troubleshooting, virus removal, operating system reinstalls, and other software services are performed on a best-effort basis. We do not guarantee that software issues will be fully resolved, that future issues will not occur, or that software services will be compatible with all hardware configurations.
12.2 Software Licensing
You are responsible for ensuring that all software installed on your device is properly licensed. We are not responsible for licensing compliance.
13. Governing Law
These Terms and Conditions are governed by the laws of the State of Michigan. Any disputes shall be resolved in the courts of Houghton County, Michigan.

15. Updates to These Terms
We may update these Terms and Conditions at any time. Updated terms will be posted on our website with a revised "Last Updated" date. It is your responsibility to review these terms before submitting your device for repair. Continued use of our services after an update constitutes acceptance of the revised terms.
16. Severability
If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.
17. Entire Agreement
These Terms and Conditions constitute the entire agreement between you and Superior Electronics & Repair regarding repair services and supersede any prior agreements or understandings, whether written or oral.
18. Acknowledgment
By submitting your device for repair, you acknowledge that you have read, understood, and agree to these Terms and Conditions, including all liability waivers and limitations of liability contained herein.
